  • The family's standard of living before the separation
  • Educational and medical needs of the child
  • Any special needs of the child
  • Other financial circumstances that affect the ability of a parent to pay child support

Does CA Child Support Stop at 18?

By California law, child support will end once the child turns 18 years old except when:

  • The child is still a full-time student in high school and lives with a parent
  • Both parents agree that custody may be extended until the age of 21

Can You Waive Child Support in California?

Even if divorcing spouses agree for there to be no child support to be payed, California Family Code Section 4001 states that, “In any proceeding where there is at issue the support of a minor child…the court may order either or both parents to pay an amount necessary for the support of the child.”

A child has the right to receive parental support by one or both of the parents and may not be waived for any reason. As long as paternity has been established by the father, then both parents are obligated to pay support for as long as the child is a minor or still in high school.
