How a Family Law Firm Can Help Youchild custody dispute in CA

Going through a divorce or separation is especially painful when children are involved. Tensions run high, and it can be difficult to reach an agreement that is fair and equitable. An experienced attorney is invaluable in these situations. Beyond representing you in court and during mediation, your attorney can explain the often-complicated laws surrounding child custody.

The two types of child custody are:

  • Physical custody: This pertains to where the children will physically live. A common judgment of joint physical custody is 50/50 in which the child spends 50 percent of their time with each parent. When one parent is given sole physical custody, the non-custodial parent is often granted visitation time.
  • Legal custody: This custody grants permission to make decisions for the child, including where the child will go to school, medical decisions, and whether or not they will have religious instruction. When one parent is given sole legal custody, they are the only one who has the authority to make these decisions.

How is Custody Determined in CA?

When the courts make a judgment regarding child custody, their primary goal is to ensure that the needs of the children in question are met. To determine what arrangement is best, the courts consider many things, including the living situation of both parents, the financial stability of both parents, any medical or educational needs of the child, and how those needs will be affected by their living situation. Additionally, if the children are old enough, the courts may also consider their wishes. California law prohibits any judge from making a custody decision based on the gender of the individuals, as both parents have an equal footing when presenting their case for custody.
