When the courts make a judgment regarding child custody, their primary goal is to ensure that the needs of the children in question are met. To determine what arrangement is best, the courts consider many things, including the living situation of both parents, the financial stability of both parents, any medical or educational needs of the child, and how those needs will be affected by their living situation. Additionally, if the children are old enough, the courts may also consider their wishes. California law prohibits any judge from making a custody decision based on the gender of the individuals, as both parents have an equal footing when presenting their case for custody.
